Driver frustrated at compensation row over damage
The broken kerb
A motorist whose car suffered a burst tyre after hitting a broken kerb has expressed frustration after a compensation claim was turned down.
Pauline Cook was turning from Farndon Road into Western Avenue on November 7 when her car struck the kerb, which was broken and sticking out into the road.
It burst the tyre so Mrs Cook submitted a £40 claim for the cost of a replacement to Leicestershire County Council. It refused to pay out, saying no defect had been noticed during a routine inspection on September 12.
Mrs Cook said she wanted to raise awareness of the condition of the road and added: “We only claimed for the tyre, not the labour, so I think we’ve been fair. It’s not much money but it’s the principle of the matter.”
The county council said it complied with its duty to maintain the highway and took immediate steps to repair the defect once it was reported.
